By accessing or using ViralBrief AI ("the Service," "we," "us"), you ("User," "you") agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and ViralBrief AI.

2. Description of Service

ViralBrief AI is an AI-powered web application designed to assist faceless YouTube content creators by generating video ideas, scripts, audio direction notes, visual scene prompts, thumbnail concepts, and competitor video analysis. The Service is provided on an "as-is" basis and may be updated, modified, or expanded over time.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into this agreement.

4. Payment Terms

Access to ViralBrief AI requires a one-time payment. Pricing is as follows:

Africa / Ghana MoMo Promo Price: GHS 89 (~$8.10 USD) via Mobile Money — limited time, expires April 21, 2026

By submitting payment, you acknowledge that:

All sales are final. We do not offer refunds once access has been granted.
It is your responsibility to ensure the correct payment amount is sent to the correct address/account.
We verify payments manually based on the Transaction ID / Hash you submit. Incorrect or fraudulent transaction references will result in denial of access.
Promotional prices (including the MoMo promo) are valid only for the stated time period and target audience. We reserve the right to verify eligibility.

5. Lifetime Access — Important Disclaimer

Lifetime access may be updated, modified, restricted, or revoked at any time in the near or distant future due to unforeseen circumstances, including but not limited to: changes in underlying AI provider terms and costs, technical infrastructure changes, legal requirements, business restructuring, or cessation of operations. The founders and operators of ViralBrief AI are not liable for any loss, damages, or inconvenience resulting from the modification or revocation of lifetime access. By purchasing, you acknowledge and accept this risk.

We will make reasonable efforts to notify users via email before any major changes to access terms. However, we are under no legal obligation to provide any specific duration of service.

6. Access and Account Security

After your payment is verified, access credentials will be sent to the email address you provide. You are responsible for:

Keeping your access credentials confidential and secure
Not sharing, reselling, or distributing your access credentials to any third party
Notifying us immediately if you suspect unauthorized use of your access

Sharing, selling, or distributing access credentials constitutes a material breach of these Terms and may result in immediate revocation of access without refund.

7. Acceptable Use Policy

You agree to use ViralBrief AI only for lawful purposes. You must not:

Use the Service to generate content that is illegal, defamatory, harassing, hateful, or deceptive
Reverse-engineer, copy, or reproduce the Service or its underlying technology for redistribution
Use automated bots or scraping tools against the Service
Attempt to bypass, disable, or interfere with the security features of the Service
Misrepresent AI-generated content as entirely human-created in contexts where disclosure is legally required
Infringe on the intellectual property rights of third parties using our tools

8. Intellectual Property

All content you generate using ViralBrief AI (scripts, prompts, ideas) belongs to you, subject to any underlying AI provider terms. You may use generated content for your YouTube channel and related commercial purposes.

The ViralBrief AI platform, including its design, code, branding, and underlying technology, remains the exclusive intellectual property of ViralBrief AI and its creators. No part of the platform may be copied, reproduced, or redistributed without express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The Service will be error-free or uninterrupted
AI-generated content will be accurate, complete, or suitable for your specific needs
The Service will meet your expectations or produce viral videos
Any output will be free from copyright claims by third parties

You use the Service and any generated content at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRALBRIEF AI AND ITS FOUNDERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR ACCESS TO THE SERVICE.

11. No Earnings Guarantee

ViralBrief AI is a tool designed to assist content creators. We make no representations, guarantees, or warranties regarding your earnings, YouTube channel growth, views, subscribers, or income as a result of using this Service. Results vary based on many factors beyond our control, including your niche, execution quality, consistency, and platform algorithm changes.

12. Refund Policy

All payments are non-refundable once access has been granted. Given the digital and immediate nature of the Service, we are unable to offer refunds after delivery of access credentials. If you experience a technical issue or believe you were charged in error, please contact us via WhatsApp within 48 hours of payment.

13. Modifications to the Service

We reserve the right to modify, update, suspend, or discontinue any aspect of ViralBrief AI at any time, with or without notice. We may add or remove features, change pricing for new users, or alter the scope of the Service. We will make reasonable efforts to communicate significant changes to existing users via email.
